Rossville man charged with DUI after crashing into trees

A Rossville man was recently arrested for DUI in Fort Oglethorpe after he was found to be intoxicated after crashing into two trees, police said.

According to the Fort Oglethorpe Police Department:

David Lee Garth, 49, of Garth Street in Rossville was arrested on Friday, Feb. 1, and charged with DUI and driving on a suspended license. He has been released from jail on bond.

Officers were dispatched to the 100 block of Gross Cresent Drive across the street from Erlanger at Hutcheson Medical Center around 5 p.m. on Feb. 1 in regards to a single-car accident.

Upon arrival officers discovered that alcohol may have led to the wreck.

“While interviewing the driver, Mr. Garth, I could smell a strong odor of alcohol on his breath,” officer David McAllister said. “His eyes were glossy and his speech was slurred. He was also unsteady on his feet.”

Garth failed multiple field sobriety tests administered by officer Brad Palmer, who was also on the scene, reports show.

During a breath test, Garth’s Intoxilyzer 5000 reading registered at 0.167, which is more than twice the legal limit for driving in Georgia.
